The Centers for Medicare and Medicaid Services (CMS) has issued final regulations implementing the new Medicare prescription drug benefit -part of the Medicare Modernization Act of 2003 (MMA).

Efforts to implement the upcoming prescription drug benefit under Medicare have picked up pace in recent weeks with the publication of new guidance for prescription drug plans on formulary guidance and access restrictions and the publication this week of final guidelines for the model therapeutic classification system. Taken together, these two announcements establish important standards for the private sector drug plans that will be offering drug coverage to Medicare beneficiaries beginning in January 2006.

Regulations for Medicare Prescription Drug Benefit Issued

The first set of proposed regulations implementing the new Medicare prescription drug benefit were published on August 3. This first "Notice of Proposed Rulemaking" (NPRM) runs more than 1,300 pages and sets forth initial guidelines for the new drug benefit that will go into effect in January 2006.
